The following are sample contracts for Armitage Photography (referred to hereafter as “Photographer”) and prospective clients (referred to hereafter as “Client”).

Wedding Contract

This agreement contains the entire understanding between the Client and the Photographer.

Pre-Wedding Consultation: The Client will outline what is required, expected, and wanted of the Photographer. The Photographer will advise on planning, logistics and timings where needed. If required, a second consultation may take place closer to the event date (about 2 weeks) to clarify details. In any case, the Photographer will attempt to contact the Client several days before the event to discuss any last minute details.

Cooperation: The Client and the Photographer consent to appropriately and politely cooperate to achieve the best possible results within the understanding of this contract. While service is ongoing, the Client agrees to give the Photographer sufficient warning to prepare for key events such as bouquet throwing, cake cutting, speeches etc. Please note that not all guests at weddings like having their photo taken. In such cases the Photographer will use their discretion but cannot be held responsible for a lack of photos of these people.

COVID-19 Health and Safety: The Client certifies that their event will abide by all Federal, State, and Local regulations and guidelines regarding the COVID-19 virus and its variants. If at any point the Photographer feels they are being placed in a situation of unreasonable risk, it is their right to remove themselves from such situation including withdrawing from the event entirely if warranted. In such an extreme circumstance, all fees paid are non-refundable.

The Schedule: The Photographer’s shooting schedule and method of operation are designed to achieve the best set of images possible. Both the Client and the Photographer therefore agree that punctuality and communication is essential to producing ideal photographic results. In cases where the wedding does not run on time, the Photographer cannot guarantee all discussed images will be captures, though every effort will be made to do so.

Paparazzi Wedding Guests: Guests will typically have their own cameras and will want to photograph the Client. In the spirit of cheerful cooperation, the Client acknowledges that the Photographer retains precedence over the guests in order to take the photographs required for the wedding services described above. The photographer is not liable for a lack of wedding photos resulting from guest interference. It is suggested that guest are asked to disregard all electronic devices during the Wedding ceremony.

House Rules: Limitations and rules imposed by registrars, ministers and venue management can affect the quality and possibility of capturing an image. For example, some ministers insist that no flash photography is allowed, and others will insist that the photographer shoot from a specific location or maintain a distance from the ceremony. The Client acknowledges that such limitations exist and is advised to make discover and such rules of the venue concerned and communicate them to the Photographer.

Accommodations: The Client agrees to provide meals and a place to sit for each photographer present if the scheduled length of service exceeds five hours. The Photographer agrees to use no more than 30 minutes of time to eat their meal.

Copyright Law: The copyright of all photographs taken remains with the Photographer. The Photographer grants the Client permission to make copies of the images under the following conditions:

• The images taken by the Photographer are for personal use by the Client, who may use them in any personal manner they wish (printing, social media, etc.)

• Sale, Publication, or any Commercial use of the images is not allowed without prior written permission from the Photographer

• The images are not altered in any form by anyone other than the Photographer

Model Release: The Client grants the Photographer and its legal representatives, heirs, and assigns, the irrevocable and unlimited consent to use the photographs of the Client for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Client hereby releases the Photographer and its legal representatives, heirs and assigns from all liability and claims in connection with the images.

Limit of Liability: The Photographer may become ill, injured, or otherwise incapacitated and unable to supply the services specified above. Under normal circumstances, the Photographer is already providing a second photographer who will then provide the agreed upon services on their own. If both persons affiliated with the Photographer are unavailable, the Photographer will attempt to hire a replacement photographer. If a replacement cannot be found, the Photographer’s liability is limited to a refund of any payments received.

The Photographer has working methods in place to prevent loss or damage to your images. However, the possibility exists that images may be lost, stolen or destroyed for reasons in or beyond the Photographer’s control. In these circumstances, liability is limited to the return of fees paid for the service or part thereof according to the percentage of images retained.

Booking fee/deposit/retainer: The booking fee is 25% of the expected overall cost for the services and is due on signing this agreement. This is a non-refundable fee. Payment of the booking fee and a signed contract are necessary to secure the stated wedding services from the Photographer. Any remaining balance is due no later than 30 days before the day of the Wedding.

General Event Contract

This agreement contains the entire understanding between the Client and the Photographer.

Cancellation/Postponement: Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. Notice of need to cancel or postpone an established appointment must be given no later than forty-eight (48) hours prior to the scheduled session time. After this time, the event of a cancellation or postponement of the portrait session by Client renders any amount already paid non-refundable. Deposits may be transferable if an alternate date is available, at the discretion of the Photographer.

Weather: If weather is a prohibitive factor in completing a scheduled session, the Photographer and Client will move to an alternate location or reschedule the remaining time to an agreed date with no additional charge.

Cooperation/No Show/Tardiness: The Photographer is not responsible if the Client and/or key individuals fail to appear or cooperate during portrait sessions. Any amount of time the client is late will be deducted from their session. Client agrees to try to arrive at least 5 minutes before their time slot to prevent this.

Copyright: All images are copyrighted to and remain the property of Armitage Photography.

Animal Liability: If Animals are to be used, the Client acknowledges and accepts that using Animals in photography is unpredictable. The Photographer or Venue is not liable for injury as a result of animal mishandling or otherwise disregarding instructions. The Photographer will work to select cooperative and low-risk Animals for use, and will inform the Client of any restrictions or required handling practices. The Photographer is not responsible for lack of cooperation on the part of any animals used.

Client Use Release: Any digital or physical images given to Client are for personal use only and shall not be modified, sold, or otherwise commercially distributed by parties other than Photographer. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Photographer. A credit line which reads “Armitage Photography” in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs.

Exhibition: Client grants Photographer permission to display selected images resulting from the session as an example of Photographer’s work and for entrance into photographic competitions and releases all claims to profits that may arise from such use of images.

Limit of Liability: In the unlikely event that all original images are lost, stolen, damaged or destroyed within or beyond Photographer’s control, the Photographer’s liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date.

Fees: Fees are determined in advance. A non-refundable deposit/retaining fee will be due at time of booking with the balance of the session and travel fees due at the time of the Client’s portrait session, payable before shooting begins.

Finishing and Retouching: Standard finishing and retouching includes stylistic editing and light blemish and stray hair removal. Requested additional or alternative editing may incur an additional fee.

Digital Prints:  Watermarked, Mid-resolution digital files are provided in jpeg format free with your session. These images are perfectly adequate for most digital screen sizes. The Client understands prints must not be made from these images and are for digital viewing only. Original quality, high-resolution digital files are available for purchase.

Entire Agreement: This agreement contains the entire understanding between Photographer and Client. It supersedes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived.
